Theft

Theft is generally considered a crime involving moral turpitude, and may impact, among other things, your immigration status as well as potential employment opportunities. There are pretrial diversion programs available to help you avoid a conviction and potentially severe consequences.

  • Class C Theft Under $100 (prosecuted in municipal courts) - punishable by a fine up to $500.

  • Class B Theft $100 < $750 – punishable by up to 180 days in county jail, and up to a $2,000 fine.

  • Class A Theft $750 < $2,500 – punishable by up to 1 year in county jail, and up to a $4,000 fine.

  • State Jail Felony Theft $2,500 < $30,000 – punishable by 6 months to 2 years in a State Jail Facility and up to a $10,000 fine.

  • 3rd Degree Theft $30,000 < $150,000 – punishable by 2 to 10 years TDCJ and up to a $10,000 fine.

  • 2nd Degree Theft $150,000 < $300,000 – punishable by 2 to 20 years TDCJ and up to a $10,000 fine.

  • 1st Degree Theft Over $300,000 – punishable by 5 to 99 years or life TDCJ and up to a $10,000 fine.
